Terms of Service

Please read these terms carefully before using our services.

These Terms of Service ("Terms") govern your access to and use of the websites, products, and services operated by Page and Provenance LLC ("Page & Provenance," "we," "us," or "our"), including:

  • PageAndProvenance.com – collector tools, Bookshelf subscriptions, Passports, Stamps, and the future marketplace (the "P&P Services"); and
  • HonestBookAI.com – AI-powered book evaluations and related tools (the "HBAI Services").

Together, these are the "Services."

By accessing or using any of the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

If you are using the Services on behalf of a business or other entity, you represent that you are authorized to accept these Terms on that entity's behalf.

These Terms apply regardless of which domain you use (PageAndProvenance.com or HonestBookAI.com) and regardless of whether you are a buyer, seller, subscriber, or visitor.

2. Our Services

2.1 HonestBookAI – AI Book Evaluations

HonestBookAI ("HBAI") provides AI-assisted evaluations of books based on user-provided information and photos. An evaluation may include:

  • Condition grading
  • Estimated value range
  • Edition / printing insight
  • Dust jacket presence and impact
  • Notes on signatures, inscriptions, or bookplate indicators
  • Narrative explanation or Passports-ready metadata

These evaluations are generated by AI systems and internal logic, trained using historical data and user-submitted materials.

No Appraisals / Not Professional Advice

HBAI evaluations are estimates only, provided for educational and informational purposes. They are not professional appraisals, legal valuations, tax advice, insurance guidance, or investment advice. You should not rely solely on HBAI evaluations for financial decisions, estate planning, insurance coverage, or tax reporting. We make no guarantee that a book will sell within any estimated range.

You are responsible for how you use any estimate created through the Services.

2.2 Page & Provenance – Bookshelf, Passports, and Marketplace

The P&P Services are designed for collectors, dealers, and enthusiasts to:

  • Store AI evaluations as Passports attached to books in a Bookshelf (and future Library/Vault tiers);
  • Track estimated values over time;
  • Apply Stamps (badges) to items (e.g., "Signed," "First Edition," "Dust Jacket Present");
  • In the future, list books for sale in a marketplace where buyers and sellers transact.

Some features (like Bookshelf subscriptions, Library/Vault tiers, or marketplace tools) may not be available at launch, and may be rolled out gradually.

2.3 Marketplace (Future / Beta)

We plan to provide a marketplace where:

  • Sellers (individual collectors or dealers) can list books;
  • Buyers can browse and purchase those books;
  • Each listing is connected to at least one AI evaluation (Passport) to improve transparency.

Page & Provenance will act primarily as a platform connecting buyers and sellers. Unless specifically indicated, we are not a party to the transaction between buyer and seller and do not take possession of the books being sold.

We may, separately, sell Page & Provenance-branded merchandise (shirts, hats, etc.) directly. These purchases are distinct from marketplace transactions and will be clearly identified as such.

3. Eligibility

You may use the Services only if:

  • You are at least 18 years old (or the age of majority in your jurisdiction);
  • You have the legal capacity to enter into these Terms; and
  • You are not barred from using the Services under any applicable law.

If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Accounts and Identity

4.1 Unified Account

We use a unified account system for both P&P and HBAI. When you create an account or sign in on HonestBookAI.com or PageAndProvenance.com, you are creating a single user account ("Account") that applies across all Services.

You are responsible for:

  • Maintaining the security of your login credentials;
  • All activity that occurs under your Account;
  • Not sharing your password or giving others access to your Account.

4.2 Accuracy of Information

You agree to provide accurate and complete information when you register and when you submit information about books, photos, or listings. You must not impersonate another person or misrepresent your association with any book, collection, or business.

5. Subscriptions, Fees, and Payments

5.1 Subscription Plans

Some features require an active paid subscription, including but not limited to:

  • Bookshelf: A monthly subscription that includes a set number of book evaluations (e.g., 10 per month) and storage of Passports in a visual library.
  • Future tiers such as Library, Vault, or Dealer accounts.

Details of current plans, evaluation limits, and pricing are displayed on the Services and may change from time to time.

We may offer early-adopter promotional pricing (e.g., a discounted rate for the first year). The promotional period and any subsequent changes will be clearly disclosed at sign-up and in renewal communications.

5.2 Per-Evaluation Fees (HonestBookAI)

HonestBookAI may be available on a per-evaluation basis (e.g., $3.99 per evaluation). When you purchase an evaluation, you are granted access to that evaluation's results for your personal or internal business use, subject to these Terms.

Per-evaluation fees are separate from subscription fees, unless otherwise specified.

5.3 Marketplace Fees

If you choose to list items for sale on the marketplace (once available), you agree to pay:

  • Any applicable subscription fees (if required for sellers);
  • Payment processing fees (e.g., Stripe fees); and
  • Marketplace fees or commissions charged by Page & Provenance on completed sales.

Details of marketplace fees will be disclosed in the seller dashboard or separate marketplace documentation, which is incorporated by reference into these Terms.

5.4 Payment Processing

All payments are processed by third-party providers such as Stripe. By providing a payment method, you authorize us and our payment processors to charge the applicable fees.

You must ensure your billing information is accurate and up to date. We are not responsible for fees or charges resulting from incorrect or expired payment methods.

5.5 Automatic Renewals & Cancellations

Subscriptions may automatically renew at the end of each billing period unless you cancel before the renewal date.

You can cancel your subscription at any time through your Account settings. Cancellation will take effect at the end of the current billing period; we generally do not provide refunds for partial months or unused evaluation credits unless required by law.

If we change subscription pricing, we will notify you in advance and give you an opportunity to cancel before the new price takes effect.

6. Use of the Services

6.1 Acceptable Use

You agree not to:

  • Use the Services for any illegal, fraudulent, or misleading purpose;
  • Upload photos or data you do not have a right to use;
  • Upload content that is defamatory, obscene, hateful, threatening, or otherwise objectionable;
  • Attempt to reverse engineer, scrape, or bulk-download the Services or data therein;
  • Interfere with the security, availability, or operation of the Services;
  • Circumvent evaluation limits, paywalls, or subscription requirements.

We may suspend or terminate your Account if we believe you are violating these Terms or misusing the Services.

6.2 Book Data, Photos, and Evaluations

When you submit information or images of books, you understand and agree that:

  • We will store and process that content in order to generate evaluations, Passports, or marketplace listing data;
  • We may use such content, in anonymized or aggregated form, to improve our models, features, and Services (see Privacy Policy for details);
  • The underlying AI models are probabilistic, not infallible;
  • Our Services may request additional photos or information for better accuracy.

You remain responsible for ensuring that any listing or description you publish is accurate and compliant with applicable law.

7. AI Evaluations and Limitations

7.1 No Guarantees of Accuracy

AI-generated evaluations, value ranges, identification of editions, or condition grades are estimates only. We do not guarantee:

  • That any value range reflects current market conditions;
  • That any book will sell within a given range, or sell at all;
  • That the AI will correctly identify all edition points, signatures, or defects.

We are not responsible for losses, missed opportunities, or disputes arising from reliance on AI output.

7.2 Not a Professional Appraisal

The Services are not a substitute for a professional, in-person appraisal by a qualified expert. For high-value items, insurance coverage, estate planning, or legal matters, you should consult an accredited appraiser or relevant professional.

8. Marketplace Terms (Future)

The following applies when the marketplace is active.

8.1 Relationship Between Buyers, Sellers, and Page & Provenance

Unless explicitly stated otherwise, Page & Provenance:

  • Is not a party to the sale contract between buyer and seller;
  • Does not inspect or guarantee the physical condition of listed books;
  • Does not hold title or possession of the books (unless expressly stated for specific programs);
  • Provides tools, AI evaluations, and Passports to support transparency.

Buyers and sellers are responsible for:

  • Price, condition, and correctness of listings;
  • Packaging, shipping, and fulfillment;
  • Handling returns or disputes in accordance with marketplace policies.

We may offer dispute resolution tools as a convenience, but we are not obligated to resolve or adjudicate disputes.

8.2 Required Evaluations

To support transparency and reduce wild pricing swings:

  • Each book listed on the marketplace must have at least one AI evaluation/Passport generated through our Services;
  • Sellers must keep listings accurate and promptly update or remove them if the book is sold elsewhere or materially changes condition.

We may remove or flag listings that appear misleading or inconsistent with previous evaluations.

9. Intellectual Property

9.1 Our IP

The Services, including all software, design, trademarks, logos, text, graphics, and proprietary methodologies (including BookLens-style valuation logic, Passports, Stamps, UI elements, and data models) are owned by Page & Provenance or its licensors and protected by intellectual property laws.

You may not:

  • Copy, modify, distribute, or create derivative works from our content or software;
  • Use our trademarks or logos without written permission;
  • Access or use the Services in a manner that competes with or replicates our core offerings.

9.2 Your Content

"User Content" includes the photos, descriptions, notes, and other materials you submit.

You retain ownership of your User Content. By submitting User Content, you grant Page & Provenance a non-exclusive, worldwide, royalty-free, sublicensable license to:

  • Store, process, and display your content as needed to operate the Services;
  • Use anonymized or aggregated data derived from your content to train and improve our models and features;
  • Display your content in your Bookshelf, Passports, marketplace listings, and other user-facing features you choose to use.

We will not sell your personal information; see Privacy Policy for details.

10. Merch and Physical Goods

We may sell promotional merchandise (e.g., shirts, hats, accessories). For such sales:

  • Title passes when we deliver the merchandise to the carrier;
  • Risk of loss passes to you upon delivery to the carrier;
  • Return, exchange, or refund policies will be described at checkout or in a separate policy.

11. Termination and Suspension

We may suspend or terminate your access to the Services at any time, with or without notice, if:

  • You violate these Terms;
  • Your use poses security or legal risk;
  • We discontinue all or part of the Services.

You may stop using the Services and close your Account at any time. Some data may be retained as required by law or for legitimate business purposes (see Privacy Policy).

12. Disclaimers

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including without limitation:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement;
  • Any warranty that evaluations or market estimates are accurate, reliable, or error-free;
  • Any warranty that the Services will be uninterrupted, secure, or free of viruses or other harmful components.

You use the Services at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, in no event will Page & Provenance, its members, employees, affiliates, or service providers be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages;
  • Any loss of profits, revenue, data, goodwill, or other intangible losses;
  • Any damages resulting from reliance on AI evaluations, mispriced items, failed sales, or disputes between buyers and sellers.

Our total liability for any claims arising out of or relating to the Services will not exceed the greater of:

  • The amount you paid to us in the 3 months preceding the event giving rise to the claim; or
  • USD $100.

Some jurisdictions do not allow certain limitations; in such cases, these limitations apply to the fullest extent permitted.

14. Indemnification

You agree to indemnify, defend, and hold harmless Page & Provenance and its members, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services;
  • Your violation of these Terms;
  • Your User Content, listings, or marketplace transactions;
  • Your violation of any rights of another party.

15. Changes to the Services and Terms

We may modify or discontinue the Services, or update these Terms, from time to time. If we make material changes, we will provide notice (e.g., by email, account notification, or banner).

By continuing to use the Services after changes take effect, you agree to the updated Terms. If you do not agree, you must stop using the Services and close your Account.

16. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or relating to them or the Services are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

Any disputes will be resolved in the state or federal courts located in Nevada, and you consent to the personal jurisdiction of those courts, except where prohibited by law.

We may require that certain disputes be resolved via binding arbitration; if so, details will be provided in a separate arbitration addendum or updated Terms.

17. Miscellaneous

  • If any provision of these Terms is held invalid, the remaining provisions will remain in full force.
  • Our failure to enforce any provision is not a waiver of our right to do so later.
  • You may not assign these Terms without our prior written consent.
  • We may assign these Terms in connection with a merger, acquisition, or sale of assets.
